What to Expect

LOCATION

To ensure objectivity and fairness, we encourage all parties to mediate at a neutral site. We typically host mediations atEngage Workspace for Lawyers,located at 8150 N. Central Expressway, 10th Floor, Dallas, TX, 75206. Used exclusively by members of the legal community, this facility provides a comfortable, private environment that is designed to support collaboration, negotiation, and open communication.

For an additional fee, mediations can be held at a neutral offsite location that is acceptable to all parties.

TIME AND DURATION

Because meaningful negotiations often gain traction as the day unfolds, we recommend booking a full-day mediation. This ensures the time and flexibility needed to address complex issues, explore creative solutions, and keep momentum toward resolution. Standard sessions run 9:30 a.m.–5:30 p.m., with lunch provided.

Half-day mediations can be arranged in less complex cases upon request. These consist of a four-hour session, either 9:30 a.m.–1:30 p.m. or 1:30 p.m.–5:30 p.m., and are billed at 60% of the equivalent full-day fee.

MEDIATION FEES

Our fees are based on the amount in dispute. Payment must be received from all parties before mediation begins. The mediation fees quote below are the total fees per party.

The mediation fee includes a preliminary analysis of the dispute, as well as a review of the confidential mediation statements provided by each side. Some mediations may exceed the allotted 8 hours. In these cases, the additional hours will be billed at $800 per hour, which will be split equally by the parties.

Your Questions, Answered

You’ll find plenty of convenient parking right outside The Gild at 8150 N. Central Expressway in Dallas. We’re on the 10th floor.
There are many hotels in Dallas; however, we recommend the DoubleTree Hotel located adjacent to our building. In addition to offering upscale accommodations, this hotel makes it easy to walk to the mediation facility.
Yes. If both parties prefer, we can accommodate Zoom mediations. However, we’ve found that in-person sessions typically foster more effective negotiation and personal interaction.
Most mediations are held during standard business hours, but we can accommodate weekend sessions when needed for an additional fee.
Mediations are typically held at Engage Workspace for Lawyers, located at 8150 N. Central Expressway, 10th Floor, Dallas, TX 75206. If all parties prefer an off-site location, we can arrange it for an additional fee to cover time and travel expenses.
We require counsel for each party to submit a 1–2-page confidential mediation statement at least three days before mediation. The statement should outline strengths, weaknesses, prior barriers to settlement, and the desired outcome. In some cases, we may schedule pre-mediation calls to help facilitate more efficient discussions.
Dallas IP Trial lawyers are experienced in not only the state and federal courts (NDTX) in Dallas, but also its legal community. While DFW is a large metroplex, the IP legal community in Dallas is small. Hiring a Dallas IP mediator provides significant experience in both domains. Darin began practicing law in Dallas at a large law firm in 1997 and has practiced IP litigation and general intellectual property counseling since 1998. He also has been a member of the Honorable Barbara M.G. Lynn American Inn of Court (Intellectual Property) since 2012. Darin’s experience with the courts and the legal community brings significant value to mediations.
The mediation fee is due from each party 7 days before the scheduled date of mediation. Mediation will not commence until we have received payment and a signed Agreement to Mediate from all parties and counsel. Failure to pay the mediation fee in advance of the mediation will result in cancellation.
Cancellation made less than 72 hours before the scheduled mediation will incur a fee equal to 50% of the quoted mediation fee.
At the mediator’s discretion, this fee may be waived for weather, sickness or other unforeseen events, or if the mediation is rescheduled within a reasonable time.
